The present General Terms of Use (hereinafter “GTU“) aim to determine the rules of use and navigation on the website “www.danae-group.fr” (hereinafter the “Website“). They set out the obligations of all users of the Website (the “User“) and of DANAE GROUP, as the publisher.
The Website is published by DANAE GROUP, a simplified joint-stock company with a capital of 500,00 euros, headquartered at 49 RUE DE PONTHIEU 75008 PARIS, registered with the Paris Trade and Companies Registry under number 982 425 696 (“DANAE GROUP”).

BEFORE FIRST USE, EVERY USER OF THE WEBSITE MUST BE AWARE OF THE WEBSITE’S FUNCTIONALITIES AND THE GTU. ANY USE OF THE WEBSITE IMPLIES FULL ACCEPTANCE OF THE GTU WITHOUT ANY RESERVATIONS. The Website aims to present the “DANAE GROUP” brand and enable contact between clients and/or Users and DANAE GROUP teams.
THE ABOVE LIST IS NON-EXHAUSTIVE AND CAN BE MODIFIED AT ANY TIME BY DANAE GROUP WITHOUT ITS LIABILITY BEING ENGAGED.

ARTICLE 2 – ACCESS AND AVAILABILITY OF THE WEBSITE

The Website is accessible 24/7 to all Users, except in the event of force majeure or occurrences beyond the control of DANAE GROUP and subject to possible breakdowns and maintenance interventions necessary for the proper functioning of the Website.

In particular, the User acknowledges the characteristics and limitations of the Internet and the Website’s operating systems and recognizes that:

• Not reproduce or have reproduced, for commercial or sales purposes, the “Le Révolutionnaire” brand products offered on the Website;
• Not harm the integrity and/or security of the Website, and in particular using viruses or any other computer program intended to damage the Website;
• Not upload to the Website, transmit or send, by any means, through the Website, any illegal, harmful, abusive, threatening or criminal content against anyone; and
• Generally, not to use the Website for purposes other than those detailed in Article 1 above.

ARTICLE 4 – INTELLECTUAL PROPERTY

IT IS SPECIFIED THAT DANAE GROUP OWNS THE “LE REVOLUTIONNAIRE” BRAND AND ITS LOGOS.
The User acknowledges the exclusive rights of DANAE GROUP over the brand and refrains from using it in any way and, more generally, from infringing the intellectual property rights of DANAE GROUP.
DANAE GROUP is the exclusive owner of all intellectual property rights relating to both the structure and the content of the Website. The entire Website is protected by French legislation relating to intellectual property. All reproduction and representation rights are thus reserved for DANAE GROUP.
As a result, all texts, graphics, icons, photographs, plans, logos, videos, sounds, brands, and more generally all elements composing the Website may not be subject to any representation, reproduction, exploitation, or extraction, in whole or in part, on any medium whatsoever, without the express and prior authorization of DANAE GROUP.
THE USER ACQUIRES NO INTELLECTUAL PROPERTY RIGHTS OVER THE WEBSITE, ITS CONTENT AND/OR THE PRODUCTS OFFERED, NOR ANY OTHER RIGHTS THAN THOSE CONFERRED BY THESE GTU.
THE USER EXPRESSLY UNDERTAKES THAT THE USE OF THE WEBSITE IN NO WAY HARMS THE RIGHTS OF DANAE GROUP, AND IN PARTICULAR THAT THIS USE DOES NOT CONSTITUTE AN INFRINGEMENT OR UNFAIR OR PARASITIC COMPETITION OF THE INFORMATION AND CONTENT OF THE WEBSITE, AND THE PRODUCTS OFFERED ON THE WEBSITE.
DANAE GROUP RESERVES THE RIGHT TO INITIATE LEGAL ACTION AGAINST ANY PERSON WHO HAS NOT RESPECTED THIS OBLIGATION.

In accordance with the applicable regulations on personal data protection, DANAE GROUP processes personal data necessary for conducting its activity, notably through the Website.
DANAE GROUP, as the data controller within the meaning of the applicable regulations, commits to processing the collected personal data in compliance with the applicable regulations.

ARTICLE 6 – LIABILITY OF DANAE GROUP

THE WEBSITE IS PROVIDED WITHOUT ANY WARRANTY WHATSOEVER. DANAE GROUP CANNOT THUS BE HELD LIABLE IN CASE OF UNAVAILABILITY AND/OR MALFUNCTION OF THE WEBSITE.
BY USING THE WEBSITE, THE USER ASSUMES ALL NEGATIVE CONSEQUENCES THAT COULD POTENTIALLY BE GENERATED BY THE WEBSITE. DANAE GROUP MAY TEMPORARILY OR PERMANENTLY INTERRUPT ACCESS TO THE WEBSITE AND ANY POSSIBLE RELATED SERVICE, NOTABLY IN CASE OF CESSATION BY IT OF THE ACTIVITY IN QUESTION, OR IN CASE OF JUDICIAL OR AMICABLE LIQUIDATION OF THE COMPANY; IN THESE LAST HYPOTHESES, THESE GTU WOULD BE TERMINATED AS OF RIGHT.

ARTICLE 7 – APPLICABLE LAW

These GTU are subject to French law. This applies both to the substantive rules and the formal rules, regardless of the places of substantial or ancillary obligation performance.
Any dispute or contestation relating to the execution or interpretation of these GTU that could not be resolved amicably between DANAE GROUP and the concerned User will be submitted to the competent courts within the jurisdiction of the Amiens Commercial Court.
